Terms and Conditions

1. Definitions

Nipzzy® : the general partnership Nipzzy, established in the Netherlands and registered with the Chamber of Commerce under number 97702528.
Customer : any natural or legal person who places an order via the webshop.
Consumer : a customer who is a natural person and acts outside a commercial or professional context.

2. Applicability

These general terms and conditions apply to all offers, orders, deliveries and agreements concluded via www.nipzzy.com .
Deviations are only valid if agreed in writing.
Any purchasing or other conditions of the customer are expressly rejected.

3. Prices

All prices listed are in euros, including VAT and excluding shipping costs, unless otherwise stated.

Nipzzy® reserves the right to change prices at any time.
If a price change occurs after the agreement has been concluded, the agreed-upon price remains valid, unless there is a legal obligation to adjust the price. In that case, the consumer has the right to cancel the agreement free of charge.

4. Payment

Payment must be made via the available payment methods in the webshop.
If payment is not received within 14 days of the reminder, the customer is in default. In that case, statutory interest and extrajudicial collection costs may be charged.
Nipzzy® is entitled to suspend deliveries in the event of late payment.

5. Retention of title

All delivered products remain the property of Nipzzy® until full payment has been received.
Until full payment has been made, the products may not be resold or encumbered.

6. Delivery

Delivery will take place while stocks last.
Orders are typically shipped within 3–4 business days to the customer's specified address.
Delivery times stated are indicative. If delivery is delayed by more than 14 days, the consumer has the right to cancel the agreement free of charge.

7. Shipping costs and returns

Shipping costs are clearly displayed during the ordering process.

In case of cancellation, the costs of returning the order will be borne by the customer, unless otherwise stated.
For returns within the Netherlands, these costs are standard €4.95.
For returns from other countries within the EU, costs may vary depending on the shipping country and the carrier chosen.

8. Right of withdrawal

The consumer has the right to cancel the agreement within 14 days after receiving the order, provided that:

the product is unused and unopened;
the hygienic seal has not been broken;
The revocation must be reported within 14 days by email to info@nipzzy.com .

After notification of withdrawal, a period of 14 days applies to return the product.
Upon receipt of the return shipment, the purchase amount will be refunded, minus the applicable return costs.

9. Complaints

Complaints must be reported by email within 14 days of receipt of the order.
The complaint should be described as clearly as possible, possibly with supporting images.
The complaint will be responded to in writing within 5 working days, including a proposed solution.

10. Warranty

Warranty is only provided for manufacturing or material defects.
Damage caused by misuse, negligence, normal wear and tear, or allergic reactions is not covered by the warranty.
After delivery, the risk of loss or damage lies with the customer.

11. Liability

Nipzzy® is only liable for direct damage resulting from intent or gross negligence.
Liability for indirect damage, consequential damage or allergic reactions is excluded.
Any liability is limited to the invoice amount of the order in question or the amount paid out by the liability insurance.

12. Force Majeure

Nipzzy® is not liable for damages resulting from force majeure, including: strikes, pandemics, transport disruptions, government measures or natural disasters.
If the force majeure situation lasts longer than 30 days, the customer has the right to terminate the agreement free of charge.

13. Intellectual property

All texts, images, designs, and other content on www.nipzzy.com and associated communication channels are the property of Nipzzy® and may not be used, reproduced, or distributed without prior written permission.

14. Applicable law

All agreements and these general terms and conditions are exclusively governed by Dutch law.
Disputes will be submitted to the competent court in the district where Nipzzy® is established.
